What is TDIU?
TDIU is a VA benefit that provides disability compensation to veterans who are unable to work due to service-connected disabilities. It is a two-part benefit, requiring both:
- A combined disability rating of 60% or more for all service-connected disabilities, or a single disability rating of 100%; and
- Unemployment due to service-connected disabilities.
Qualifying for TDIU
Service-Connected Disability
To qualify for TDIU, veterans must first have a service-connected disability. This means that the disability must have been caused or aggravated by active military service. The VA rates disabilities on a scale of 0% to 100%, with higher ratings indicating greater severity.
Combined Rating of 60% or Higher
Veterans who have a combined disability rating of 60% or higher are automatically eligible for TDIU. This means that the VA has determined that their service-connected disabilities collectively prevent them from working.
Single Rating of 100%
Veterans who have a single disability rating of 100% are also eligible for TDIU. This is because a rating of 100% indicates that the disability is totally disabling.
Unemployment Due to Service-Connected Disabilities
In addition to meeting the disability rating requirements, veterans must also be unemployed due to their service-connected disabilities. This means that their ability to work is significantly impaired by their disabilities.
Legal Presumption of Unemployability
The VA presumes that veterans are unemployable if they have a single service-connected disability rated at 60% or more. This presumption can be rebutted by the VA if it has evidence that the veteran is able to work.
Applying for TDIU
Veterans who believe they meet the criteria for TDIU should apply through the VA. The application process involves submitting:
- VA Form 21-526EZ, Application for Disability Compensation and Related Compensation Benefits
- Evidence of service-connected disabilities
- Evidence of unemployment due to service-connected disabilities
Veterans can submit their application online, by mail, or in person at a regional VA office.
The VA Decision-Making Process
Once the VA receives an application for TDIU, it will review the veteran's service and medical records. The VA will then determine whether the veteran meets the eligibility criteria for TDIU. The VA may request additional medical or other evidence to support its decision.
The VA's decision can be appealed if the veteran disagrees with the determination. The appeal process involves filing a Notice of Disagreement (NOD) with the VA.
